Terms of service

These Terms of Service ("Terms") govern your use of the PEEKLO website, content, products, and services (collectively, the "Services"). By visiting the site or placing an order, you agree to these Terms and to the policies linked from the site. If you do not agree, do not use the Services.

1. Eligibility and Accounts

You must be at least 18 years old or the age of majority where you live to place an order. You are responsible for providing accurate, current information and for activity under any account you create.

2. Orders, Prices, and Payment

An order is an offer to purchase. We may accept, reject, limit, or cancel an order for legitimate reasons, including product availability, suspected fraud, pricing or description errors, or legal restrictions. If we cancel after payment, we will refund the cancelled amount. Prices, promotions, availability, taxes, and shipping options may change before an order is submitted. You authorize us and our payment providers to charge the payment method selected at checkout.

3. Product Information

We try to display product descriptions, colors, images, dimensions, and included components accurately. Screen settings and normal production variations may cause minor differences. We will not make a materially different substitution without your consent. Product availability is not guaranteed.

4. Child Safety and Supervision

PEEKLO kits are currently recommended for children age 3 and older with continuous, attentive adult supervision. Some activities contain removable or small components that may present a choking hazard. They are not for children under 3. Inspect products before each use, keep small components away from younger children, stop using any damaged component, and follow all instructions and warnings supplied with each activity.

PEEKLO products do not replace responsible adult care or supervision. The purchasing adult is responsible for deciding whether each component is appropriate for the specific child and setting.

5. No Guaranteed Outcome

Children differ in age, interests, mood, abilities, and environment. We do not promise a particular amount of quiet time, attention, entertainment, learning, developmental progress, behavioral change, therapeutic benefit, or screen-time reduction. Product and editorial content is general information and is not medical, therapeutic, educational, or childcare advice.

6. Three-Outing Promise, Returns, and Shipping

The 60-day Three-Outing Promise and all returns, cancellations, refunds, and replacements are governed by our Return and Refund Policy. Fulfillment and delivery are governed by our Shipping Policy. Those policies form part of these Terms.

7. Acceptable Use

You may not misuse the Services, interfere with their security or operation, introduce malicious code, collect information without authorization, impersonate another person, violate law, infringe rights, or use the Services to develop or promote unlawful, harmful, or fraudulent activity. We may suspend access for a material violation.

8. Intellectual Property

The PEEKLO name, site design, text, graphics, photographs, videos, logos, product presentation, and other site content are owned by or licensed to PEEKLO and are protected by applicable intellectual-property laws. You may use the site only for personal, non-commercial shopping and information. No content may be copied, republished, sold, or commercially exploited without written permission, except as law expressly allows.

9. Reviews and Submitted Content

If you submit a review, photo, suggestion, or other content, you confirm that you have the right to do so and that it is accurate, lawful, and does not violate another person's rights. You grant PEEKLO a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, and display that content in connection with the Services and our marketing, subject to applicable privacy law. We may remove unlawful, misleading, abusive, or irrelevant content.

10. Third-Party Services and Links

The Services may rely on third parties, including Shopify for commerce and checkout and Vercel for storefront hosting. Third-party services and websites are governed by their own terms and privacy practices. We are not responsible for third-party content or services outside our reasonable control.

11. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties except to the extent they cannot legally be excluded. We do not warrant uninterrupted or error-free access. Nothing in these Terms excludes an express product promise or a non-waivable statutory warranty.

12. Limitation of Liability

To the fullest extent permitted by law, PEEKLO and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or data, arising from the Services. To the fullest extent permitted by law, total liability for a claim will not exceed the amount you paid to PEEKLO for the product or order giving rise to that claim.

These limitations do not apply to liability that cannot legally be limited, including liability for fraud, willful misconduct, gross negligence, or personal injury caused by negligence where applicable law prohibits limitation.

13. Indemnification

To the extent permitted by law, you agree to indemnify PEEKLO against third-party claims and reasonable costs caused by your unlawful misuse of the Services, your material breach of these Terms, or your violation of another person's rights. This does not apply to claims caused by PEEKLO's own unlawful conduct.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Courts located in Miami-Dade County, Florida will have jurisdiction, except that any mandatory consumer law or legally required venue remains available. Before filing a claim, please contact info@shoppeeklo.com so we can try to resolve the issue informally.

15. Changes, Severability, and Entire Agreement

We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively unless law permits otherwise. If one provision is unenforceable, the remaining provisions continue in effect. These Terms and the policies referenced in them are the entire agreement concerning the Services, except for any additional terms expressly agreed in writing.
